Independent or Non-Affiliated Candidate's Application for Repayment of Surplus Funds (EC 20009) – Instructions

When to use this form

This form is used to apply to Elections Canada for the repayment of a surplus to an independent or non-affiliated candidate if an electoral campaign expense remains to be paid after the disposal of surplus or if the candidate is running in a subsequent election.

To set up direct deposit of the repayment, complete the Direct Deposit Enrolment or Change Request (EC 20039) and submit it by mail or email to the address listed below, together with a voided cheque or a document approved by your financial institution.

Payment of (an) electoral campaign expense(s)

The official agent of a candidate who ran as an independent or non-affiliated candidate, and whose campaign disposed of a surplus to Elections Canada, might become aware that there is still (an) electoral campaign expense(s) to pay.

The official agent can apply to Elections Canada to have surplus funds repaid. The maximum repayment is the lesser of:

  • the claim to be paid
  • the amount disposed of as surplus

After payment of an expense in full, the official agent has to file an updated Candidate's Electoral Campaign Return within 30 days of the payment.

Note that if the claim is unpaid 36 months after election day, the official agent or the candidate has to seek authorization from Elections Canada or a judge before paying it.

Repayment for a subsequent election

The official agent of a candidate who is running as an independent or non-affiliated candidate, and whose campaign had disposed of a surplus to Elections Canada in a previous election, can apply to have the surplus repaid.

The surplus will be repaid to the candidate's campaign if:

  • the candidate is running in their first election since they disposed of the surplus, or
  • the candidate ran in one or more intervening by-elections but was not endorsed by a registered party at the first of those by-elections

Tips for completing this form

Section C – Surplus disposed of: election information and amount

Provide details of the election after which the surplus funds were disposed of to Elections Canada and the amount that was disposed.

Section D – Surplus repayment: information and amount

Provide details of the election it relates to and the amount requested.

ED code, Electoral district:

For a list of electoral district codes and names, refer to Annex I for a list of federal electoral districts for the 2013 Representation Order (338 electoral districts) or Annex II for a list of federal electoral districts for the 2023 representation orders (343 electoral districts).

Declaration:

The declaration must be signed and dated by the official agent making the request. The official agent must be the agent in Elections Canada's registry at the time of signing.
